In an era when truth commissions are at the fulcrum of "transitional justice," soliciting the testimony of victims and commanding that of perpetrators in forums other than criminal trials may achieve a dimension of justice lost in traditional juridical proceedings.

In this article, the authors articulate the question “From where do we speak?” They explain the status of this question and then discuss the question “From where do the authors of the document Justice in the World speak?” They identify four reference points: a pneumatologic commitment, a perception of injustice, a belief in the Gospel basis of action on behalf of justice, and a recognition of self-involvement. This part of the text has been written by Clemens Sedmak. In the second (...) part, they ask the question: “From where do we speak now?” After a few remarks on the climate crisis and the sexual abuse crisis, they focus on “the wounded sociality” of the present day. They explore the relationship between justice and this wounded sociality, taking the categories of social friendship and fraternity as points of reference (from Pope Francis’s encyclicals Laudato si’ and Fratelli tutti), and enter a conversation with three authors: Michael Sandel, Teresa Godwin Phelps, and Paul Ricoeur. Victim/survivor stories have become one of the primary means for conveying human rights abuses. Even as these kinds of stories have captured our collective imagination, we do not know much about how they operate in a transitional democracy: whether they are transformative and contribute to the peacemaking process, or disruptive and can thwart the process.This article discusses the value of such stories and asks, first, whether an emerging democracy has an ethical obligation to provide spaces for victims and survivors to (...) tell their stories of the harms that befell them under the former regime. It concludes that victim/survivor storytelling can assist former victims in finding and building of voice that enables them to become contributing citizens in the new country. It enables them to become less alienated from and suspicious of the state, and to become empowered enough to participate in governance. It is thus in a country’s best interest to encourage storytelling activities. Second, the article attempts to provide a framework by which we might recognize different kinds of stories and begin to distinguish between those that a country should support and those that it should discourage. Gender dysphoria (GD) is marked by an incongruence between a person’s biological sex at birth, and their felt gender (or gender identity). There is continuing debate regarding the benefits and drawbacks of physiological treatment of GD in children, a pathway, beginning with endocrine treatment to suppress puberty. Currently, the main alternative to physiological treatment consists of the so-called “wait-and-see” approach, which often includes counseling or other psychotherapeutic treatment. In this paper, we argue in favor of a “third pathway” for the (...) diagnosis and treatment of GD in youths. To make our case, we draw on a recent development in bioethics: the phenomenological approach. Scholars such as Slatman and Svenaeus have argued that the extent to which the body can (or should be) manipulated or reconstructed through medical intervention is not only determined by consideration of ethical frameworks and social and legal norms. Rather, we must also take account of patients’ personal experience of their body, the personal and social values associated with it, and their understanding of its situation in their life: their narrative identities. We apply this phenomenological approach to medicine and nursing to the diagnosis and treatment of GD in youth. In particular, we discuss Zahavi and Martiny’s conception of the phenomenological interview, in order to show that narrative techniques can assist in the process of gender identification and in the treatment of youth presenting with GD. We focus on two case studies that highlight the relevance of a narrative-based interview in relations between patients, HCPs, and family, to expose the influence of social ideologies on how young people presenting with GD experience their bodies and gender. In her Introduction, Tymieniecka states the core theme of the present book sharply: Is culture an excess of nature's prodigious expansiveness - an excess which might turn out to be dangerous for nature itself if it goes too far - or is culture a 'natural', congenial prolongation of nature-life? If the latter, then culture is assimilated into nature and thus would lose its claim to autonomy: its criteria would be superseded by those of nature alone. Of course, nature and culture (...) may both still be seen as being absorbed by the inner powers of specifically human inwardness, on which view, human being, caught in its own transcendence, becomes separated radically in kind from the rest of existence and may not touch even the shadow of reality except through its own prism. Excess, therefore, or prolongation? And on what terms? The relationship between culture and nature in its technical phase demands a new elucidation. Here this is pursued by excavating the root significance of the 'multiple rationalities' of life. In contrast to Husserl, who differentiated living types according to their degree of participation in the world, the phenomenology of life disentangles living types from within the ontopoietic web of life itself. The human creative act reveals itself as the Great Divide of the Logos of Life - a divide that does not separate but harmonizes, thus dispelling both naturalistic and spiritualistic reductionism. The last decade has seen a dramatic increase in interest in the extent to which morphological evolution depends on changes in regulatory pathways. Insects provide a fertile ground for study because of their diversity and our high level of understanding of the genetic regulation of development in Drosophila melanogaster. However, comparable genetic approaches are presently possible in only a small number of non‐Drosophilid insects. In a recent paper, Hughes and Kaufman(1) have used a new methodology, RNA interference, in the milkweed (...) bug, Oncopeltus fasciatus, to phenocopy the effects of mutations in Hox genes. RNA interference involves the injection of double‐stranded RNA of the same sequence as the relevant mRNA resulting in a depletion of that transcript.(2) Hughes and Kaufman focused on the gnathal segments, which elaborate specialized appendages important to feeding. Employing her original concept of the ontopoiesis of life, the author uncovers the intrinsic law of the primogenital logos - that which operates in the working of the indivisible dyad of impetus and equipoise. This is the crucial, intrinsically motivated device of logoic constructivism. This key instrument is engaged - is at play - at every stage of the advance of life. In a feat unprecedented in the history of western philosophy, the emergence and unfolding of the entire orbit of (...) the human universe is shown to bear out this insight. Furthermore, the intrinsic rhythms of impetus and equipoise are taken as a guide in uncovering the workings of the logos all at once, in contrast to the piecemeal exposition of a single line of argument. In a schema covering the entire career of beingness-in-becoming between the infinities of origin and destiny, an historically unprecedented harmonizing all sectors of rationality is accomplished in a span of reflection comparable to Spinoza's Ethics. The work draws on interdisciplinary investigations in both science and the arts. All of the history of Occidental philosophy finds summary in it, even as feelers, guidelines, leitmotifs are thrown out for its future development. The nature of life consists in a constructive becoming (see Analecta Husserliana vol. 70). Though caught up in its relatively stable, stationary intervals manifesting the steps of its accomplishments that our attention is fixed. In this selection of studies we proceed, in contrast, to envisage life in the Aristotelian perspective in which energia, forces, and dynamisms of life at work are at the fore. Startling questions emerge: `what distinction could be drawn between the prompting forces of life and its formation? (...) Or, is this distinction a result of our transcendental faculties?' The answers to these questions reveal themselves, as Tymieniecka proposes, at the phenomenologically ontopoietic level of life's origination where transcendentality surges. (shrink)

Understanding life through its origins reveals the groundwork underlying the differentiations of its autonomous generative matrixes. Following the primogenital matrix of generation, the three generative matrixes of the specifically human sense of life establish humanness within the creative human condition as the existential sphere of sharing-in-life.

Although the d efinition of truth first proposed by Aristotle and maintained as the reference point for all succeeding views was situated in the intellective sphere of rationality/logos in the human unfolding, its validity, that is, the validity of the proposition fram ing it, and its verification reaches far below the logical sphere of a statement. Truth's validity reverberates down from the intellective sphere of the mind's rationality into the spheres of sense that sustain it, within the multiple spheres of (...) the network, of sense in\which; the logos of life projects its manifestation1 through living beings and whole world of life. To grasp the full significance of notions of truth we cannot stop at any one perspective or sphere, whether the cognitive, intertextual, or pragmatic. To understand what "truth" means we should elucidate it in its origin and nature, that is, in its generative significance for the entire expanse of life and in its role within the logoic schema of its dynamic manifesta tion. I propose to outline this in a succinct way in what follows. Truth will emerge as a crucial logoic device, as the regulative vortex for the ontopoietic balancing out of life's forces in their constructive course. (shrink)
